Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PhotoPusher ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

PhotoPusher is a macOS application developed by Armchair Caesars (Mark Huthmaker) that allows users to bulk upload photos and videos from their Mac to Google Photos. The App converts files to compatible formats as needed and manages the upload process.

3. Google Account

PhotoPusher requires a Google account to function. By using the App, you authorize it to access your Google Photos library for the purpose of uploading content. Your use of Google Photos is also subject to Google's Terms of Service.

4. Your Content

You retain all ownership of the photos and videos you upload through PhotoPusher. The App does not claim any rights to your content. You are responsible for ensuring you have the right to upload the content you select.

5. Acceptable Use

You agree not to use PhotoPusher to:

Upload content that violates any applicable law or regulation
Upload content that infringes on the intellectual property rights of others
Circumvent any limitations of the Google Photos API
Reverse engineer, decompile, or disassemble the App

6. Disclaimer of Warranties

PhotoPusher is provided "as is" without warranties of any kind, express or implied. Armchair Caesars does not warrant that the App will be error-free, uninterrupted, or that it will meet your specific requirements. File conversion and upload are performed on a best-effort basis.

7. Limitation of Liability

To the maximum extent permitted by law, Armchair Caesars shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to data loss, upload failures, or file corruption.

8. Google Photos API

PhotoPusher relies on the Google Photos API. Changes to the API by Google may affect the App's functionality. Armchair Caesars is not responsible for service interruptions caused by third-party API changes.

9. Updates

Armchair Caesars may release updates to the App from time to time. Continued use of the App after updates constitutes acceptance of any modified terms.

10. Termination

You may stop using PhotoPusher at any time by uninstalling the App. You can revoke Google account access at any time through your Google Account permissions.

11. Changes to Terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date.
